Article 1 — Purpose
These Terms of Use (hereinafter "ToU") govern access to and use of the website dojotcg.com (hereinafter the "Site") published by Dojo TCG. They apply to any visitor or user of the Site, regardless of whether a purchase is made.
For everything concerning the sale of products, payment, delivery, the right of withdrawal, warranties and order-related disputes, these ToU refer to the Terms and Conditions of Sale (T&Cs), which exclusively govern the sales relationship.

Article 3 — Acceptance of the ToU
Access to and use of the Site imply full and unreserved acceptance of these ToU. If the user does not accept these conditions, they must immediately stop using the Site.
The publisher reserves the right to amend the ToU at any time. The applicable ToU are those in force on the date of connection to or use of the Site.
Article 4 — Access to the Site
The Site is accessible free of charge, 24/7, subject to maintenance operations, technical failures or any event of force majeure.
The publisher strives to ensure continuous access but cannot guarantee it and cannot be held liable for interruptions, malfunctions, or unavailability, nor for any direct or indirect damage resulting therefrom.
The user acknowledges that they have the skills and technical means necessary to access the Site and use its features. Internet access costs (equipment, subscription, communication) remain solely their responsibility.
Article 5 — Customer account
Certain Site features (placing an order, tracking, purchase history, wishlist) require the creation of a customer account. Creating an account is free and open to natural persons who are of legal age and legally capable.
The user undertakes to:
- provide accurate, up-to-date and complete information when creating the account;
- keep their login credentials confidential;
- inform the publisher without delay of any unauthorised use of their account.
The user is solely responsible for all actions carried out via their account. The publisher reserves the right to suspend or delete any account in the event of a breach of these ToU, fraudulent behaviour or an attempt to harm the Site.
The user may delete their account at any time by sending a request to contact@dojotcg.com.
Article 6 — Acceptable use
The user undertakes to use the Site in accordance with the applicable legal provisions, these ToU and with respect for others. The following are notably prohibited:
- any mass or automated extraction of Site content (scraping, crawling, data harvesting, copying of the product database) without the publisher's prior written authorisation;
- any use of bots, scripts or automated tools to add to cart, reserve or place orders under more favourable conditions than those offered to human users;
- any attempt to intrude, alter, overload, disrupt or circumvent the security measures of the Site, servers or associated networks;
- any reproduction, modification, distribution or use of Site content (photographs, descriptions, design) for commercial purposes without prior authorisation;
- the creation of multiple accounts in order to circumvent any purchase limits placed on certain limited-availability products;
- the transmission of any unlawful, abusive, defamatory content, or content contrary to public decency or public order.
Any breach of these obligations may result in the immediate suspension of access to the Site, without notice or compensation, and may engage the user's civil and/or criminal liability.
Article 7 — Intellectual property
All elements making up the Site — graphic identity, Dojo TCG logo, product photographs, editorial texts, descriptions, database, architecture, source code, design — are the exclusive property of Dojo TCG or its licensors, and are protected by copyright, trademark law and the sui generis database right.
Any reproduction, representation, modification, publication, transmission or exploitation, in whole or in part, in any form whatsoever, is strictly prohibited without the prior written authorisation of Dojo TCG, under penalty of prosecution for infringement (Articles L.335-2 et seq. of the French Intellectual Property Code).
Third-party trademarks, logos and product names (in particular Pokémon™, Nintendo, The Pokémon Company, as well as the grading companies cited) remain the exclusive property of their respective owners. Their mention on the Site is solely intended to identify the products offered for sale and may not be interpreted as a partnership, affiliation or authorisation from their owners.
Article 8 — Hyperlinks
The Site may contain hyperlinks to third-party sites. Dojo TCG exercises no control over these sites and disclaims all liability for their content, terms of use, privacy policy or any damage resulting from their consultation.
Creating hyperlinks to the Site is free, provided that it does not aim to harm Dojo TCG's image and that the source is clearly identified. The publisher reserves the right to request the removal of any link deemed contrary to its interests.
Article 9 — Cookies and personal data
Use of the Site involves the placing and reading of cookies under the conditions provided for in the Cookie Policy available on the Site. The user may set their consent at any time via the dedicated banner.
The processing of personal data is governed by the Privacy Policy available on the Site, in accordance with the General Data Protection Regulation (GDPR) and the amended French Data Protection Act.
Article 10 — Site availability and liability
The publisher makes every effort to ensure the accuracy of the information published on the Site, without however guaranteeing its completeness or freedom from errors. The information is provided for guidance only and may be changed without notice.
The publisher cannot be held liable for:
- direct or indirect damage resulting from the use of the Site or an inability to access it;
- errors, omissions or inaccuracies in the published content;
- the possible presence of viruses, malware or other harmful elements transmitted by third parties and liable to affect the user's computer equipment;
- the consequences of the use by a third party of the account of a user who has not kept their credentials confidential.
Article 11 — Amendment of the ToU
The publisher reserves the right to amend these ToU at any time, without notice. Users are invited to regularly consult the latest version in force, the date of which is indicated at the top of the document. Continued use of the Site after amendment constitutes acceptance of the new ToU.
Article 12 — Governing law and jurisdiction
These ToU are governed by French law. In the event of a dispute, and after any attempt at amicable resolution has failed, the French courts shall have sole jurisdiction, subject to the mandatory provisions applicable to the consumer in their country of residence.
