Article 1 — Purpose and scope

These Terms and Conditions of Sale (hereinafter "T&Cs") govern all contractual relations between Dojo TCG (hereinafter the "Seller") and any non-trader natural person (hereinafter the "Customer") making a purchase on the website dojotcg.com.

Any order placed on the site implies the Customer's full and unreserved acceptance of these T&Cs. The Seller reserves the right to amend its T&Cs at any time; the applicable T&Cs are those in force on the date of the order.

Article 3 — Products

Dojo TCG offers for sale collectible trading cards (single cards, sealed products, slabs graded by third-party grading companies) as well as collection-related accessories.

The essential characteristics of each product (language, condition, grading company, assigned grade, certification number where applicable) are described on the corresponding product page. The Customer is invited to review them before any purchase.

The photographs illustrating the products are as faithful as possible to reality, but cannot bind the Seller with regard to minor variations in colour, reflections or presentation related to the viewing device.

Products are offered subject to available stock. If a product becomes unavailable after the order is placed, the Seller will inform the Customer by email as soon as possible and will fully refund the amounts paid.

For single cards, the image shown on the product page is the official artwork of the card (reference scan): it allows the card to be identified but does not constitute a photograph of the specific copy delivered. Only the condition stated on the product page describes the copy sold. This condition is defined according to the scale detailed on the "Card Conditions" page, which forms an integral part of the product description.

Article 4 — Prices

Product prices are shown in euros, all taxes included, excluding delivery costs. The applicable delivery costs are specified at checkout, before payment.

The Seller reserves the right to change its prices at any time. However, ordered products will be invoiced at the price in force when the order was recorded.

For any delivery outside the European Union, the Customer may be liable for customs duties and local taxes, borne solely by them. Dojo TCG does not currently deliver outside the EU; this clause is provided for information only, in view of possible future developments.

Article 5 — Order

To place an order, the Customer follows the online process on dojotcg.com: product selection, add to cart, cart validation, identification, choice of delivery method, choice of payment method, review of the summary, payment.

Final confirmation of payment constitutes acceptance of these T&Cs and formation of the sales contract. A confirmation email summarising the order will be sent to the Customer at the address provided at the time of the order.

The Seller reserves the right to refuse or cancel any order of an abnormal nature, in particular in the event of a previous dispute with the Customer, suspected fraud, or non-payment.

Article 6 — Payment terms

Payment is due immediately upon ordering. The accepted payment methods are indicated on the site during the order process (credit card, approved electronic wallets, etc.).

Transactions are secured by the payment provider integrated into the Shopify platform. Dojo TCG has no access to the Customer's banking data.

If payment is declined by the bank or the payment provider, the order will be automatically cancelled and the Customer will be informed.

Article 7 — Delivery

7.1 Delivery areas

Dojo TCG delivers to the following destinations:

  • Metropolitan France (Corsica included);
  • Germany, Belgium, Spain, Italy, Luxembourg, Netherlands, Poland, Portugal.

French overseas departments and territories, other EU member states not listed above, and countries outside the European Union are not served at this time.

7.2 Delivery times

The indicative delivery times, from the shipment of the parcel, are:

  • Metropolitan France: 1 to 2 business days
  • European Union (served areas): 3 to 5 business days

These times do not account for any delays attributable to the carrier, local postal services or cases of force majeure.

Orders are shipped within 1 to 3 business days from payment confirmation, unless otherwise stated on the product page.

7.3 Delivery costs

Delivery costs are calculated based on the weight of the parcel, the destination and the carrier chosen by the Customer. They are specified at checkout, before payment.

7.4 Receipt of the parcel

Upon receipt of the parcel, the Customer is invited to check the integrity of the packaging. If damage is observed (damaged, opened or wet parcel), the Customer is invited to:

  • refuse the parcel or make precise and detailed reservations on the carrier's delivery slip;
  • report the damage to the Seller by email at contact@dojotcg.com as soon as possible, attaching photographs and a description.

These steps help facilitate the handling of the claim with the carrier. They do not deprive the Customer of the legal warranties available under Articles 9 et seq. of these T&Cs.

Article 8 — Right of withdrawal

8.1 Principle

In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) calendar days from receipt of the product to exercise their right of withdrawal, without having to give reasons or pay penalties.

To exercise this right, the Customer sends, before the deadline expires, an unambiguous statement expressing their wish to withdraw (by email at contact@dojotcg.com, or using the model withdrawal form appended to these T&Cs), stating the order number and the product(s) concerned.

The Customer must return the product at their own expense, if possible in its original packaging and with all accessories, instructions and documents. The Customer may be held liable only for any depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods.

The Seller will refund all amounts paid, including the standard delivery costs initially paid, within fourteen (14) days from the recovery of the returned product, or from the date on which the Customer provides proof of shipment of the product, whichever occurs first. The refund is made using the same payment method as that used for the order, unless the Customer expressly agrees to another method.

8.2 Exclusion from the right of withdrawal — Graded slabs

The right of withdrawal does not apply to graded cards (slabs) sold by Dojo TCG, in accordance with Article L221-28 3° of the French Consumer Code, which excludes from the right of withdrawal "goods made to the consumer's specifications or clearly personalised".

Indeed, each graded slab constitutes a unique and clearly personalised item due to:

  • the condition grade assigned to the card by the grading company, specific to each copy;
  • the unique certification number affixed to the sealed case;
  • the unique grader / card / grade / number combination, which makes it a non-interchangeable product.

This exclusion is brought to the Customer's attention clearly and prior to any order, on each slab's product page, as well as in the order summary before payment is confirmed.

8.3 Exclusion from the right of withdrawal — Sealed single cards

Single cards are supplied in protective packaging sealed with a Dojo TCG custom tamper-evident label ("void" device). Once peeled off or damaged, this label reveals an indelible marking that makes any restoration to the original state impossible.

In accordance with Article L221-28 5° of the French Consumer Code, the right of withdrawal does not apply to single cards whose custom seal has been opened, unsealed or damaged after delivery.

This device has a dual protective function:

  • Authenticity guarantee — it certifies that the card has not been substituted between delivery and a potential return;
  • Integrity guarantee — it certifies that the card has not been handled outside its original protection, which could alter its condition.

The Customer may examine the card through its transparent packaging without breaking the seal. In that case, the 14-day right of withdrawal remains fully applicable.

8.4 Other exclusions

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal also does not apply to boosters and other factory-sealed products whose packaging has been opened by the Customer after delivery.

Article 9 — Legal warranties

Independently of any commercial warranty, the Seller remains bound by the following legal warranties.

LEGAL WARRANTIES

The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal warranty of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.

The legal warranty of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The legal warranty of conformity gives the consumer the right to the repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.

If the consumer requests the repair of the goods, but the seller imposes replacement, the legal warranty of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price by keeping the goods, or terminate the contract with a full refund against return of the goods, if:

  1. the professional refuses to repair or replace the goods;
  2. the repair or replacement of the goods occurs after a period of thirty days;
  3. the repair or replacement of the goods causes a major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
  4. the lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious as to justify an immediate price reduction or termination of the contract. In that case, the consumer is not required to first request the repair or replacement of the goods.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are out of use with a view to their repair or replacement suspends the remainder of the warranty until the repaired goods are delivered.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.

The consumer also benefits from the legal warranty against hidden defects pursuant to Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This warranty allows for a price reduction if the goods are kept, or a full refund against return of the goods.

9.1 Legal warranty of conformity

The Seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery, under the conditions of Articles L217-3 et seq. of the French Consumer Code. The Customer has a period of two (2) years from delivery of the goods to act.

9.2 Warranty against hidden defects

The Seller is also bound by the warranty for hidden defects of the item sold under the conditions of Articles 1641 et seq. of the French Civil Code. The Customer may choose to invoke this warranty within two (2) years from the discovery of the defect.

Article 10 — Complaints and dispute procedure

Any complaint regarding an order must be sent to the Seller within a reasonable time, by email at contact@dojotcg.com, stating the order number and the subject of the complaint, together with any useful supporting evidence (photographs, proof of receipt, etc.).

To ensure the quality of service and the security of transactions, the Seller keeps, for each order, internal documentation (photographs and/or videos of the packaging and contents before shipment, authentication markings not visible to the naked eye). These items may be produced in the event of a dispute.

Article 11 — Liability

The Seller cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular: service interruption, external intrusion, presence of computer viruses, or any event qualifying as force majeure.

Article 12 — Force majeure

The Seller cannot be held liable for non-performance or improper performance of its obligations attributable to a case of force majeure as defined by Article 1218 of the French Civil Code and the case law of the French courts.

Article 13 — Protection of personal data

The processing of the Customer's personal data is governed by our Privacy Policy, in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.

Article 14 — Intellectual property

All elements of the dojotcg.com website (text, photographs, logos, layout, design) are the exclusive property of Dojo TCG. Any reproduction without prior authorisation is prohibited.

Article 15 — Mediation and dispute resolution

In accordance with the provisions of the French Consumer Code on consumer dispute mediation, after contacting Dojo TCG's customer service and failing a satisfactory response within two (2) months, the Customer may use, free of charge, a consumer mediation procedure with:

Article 16 — Governing law and jurisdiction

These T&Cs are governed by French law. In the event of a dispute, and after any attempt at amicable resolution and mediation has failed, the French courts shall have sole jurisdiction. For sales within the European Union, the mandatory provisions applicable to the consumer in their country of residence remain reserved.

Article 17 — Acceptance of the T&Cs

By confirming their order, the Customer acknowledges having read, understood and unreservedly accepted these T&Cs.
